Agreement to Terms

By accessing or using Kindergraz (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Kindergraz is a platform designed to help parents and guardians organize playdates and coordinate social activities for their children. The Service includes:

• Availability broadcasting and scheduling tools
• Playdate invitation and RSVP management
• Community connections with other families
• Event discovery and coordination
• Child profile management

Important: Kindergraz is designed to help you organize playdates with families you already know. It is not a social discovery platform. All connections require mutual consent.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information
• You will comply with all applicable laws and regulations

User Accounts

Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

User Conduct and Responsibilities

You agree not to:

• Provide false or misleading information
• Impersonate another person or entity
• Harass, threaten, or harm other users
• Upload or transmit harmful, offensive, or illegal content
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for commercial purposes without authorization
• Scrape, data mine, or extract user information

Child Safety

As a parent or guardian using Kindergraz, you acknowledge and agree that:

• You are solely responsible for the safety and supervision of your children
• Kindergraz facilitates coordination but does not supervise or monitor playdates
• You will verify the identity of other users before meeting in person
• You will take appropriate safety precautions during playdates
• You will use the QR code verification feature when meeting new families

Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

Intellectual Property

The Service and its content (excluding user-generated content) are owned by Kindergraz and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code

User Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of user information

Important: Kindergraz does not conduct background checks on users. You are responsible for verifying the identity and trustworthiness of other users before interacting with them in person.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDERGRAZ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use the Service
• Interactions with other users
• Any content or conduct of third parties
• Unauthorized access to your information

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Kindergraz and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any rights of another person or entity
• Your content or conduct on the Service

Dispute Resolution

Governing Law

Arbitration
